A person who is in possession of the premises or land where someone suffers an injury may be responsible for the injuries. This theory of legal liability is referred to as premises liability.

Premises Possession

The person is deemed to be in possession of the premises or land if:

  • The person occupies with intent to control the premises or land
  • No other person has occupied with intent to control the premises or land
  • The person is entitled to occupy the land and no other person is in possession

The Plaintiff

In most states, a property owner may have a different duty to an injured person depending on the legal status of the injured person at the time of the accident. The laws usually establish a different duty on the property owner for an invited guest as opposed to trespasser. An invited or licensed party is entitled to expect ordinary care or warning of any risks from the possessor. The possessor is responsible for routine inspection of the premises in order to maintain the safety of invitees and licensees.

A trespasser is one who enters the premises for their own purpose without the express permission of the possessor. In this case, the owner of the premises or land may have no knowledge of the existence of the trespasser. Depending on the actual circumstances, the owner may not be legally responsible for injuries sustained by the trespasser.

Negligent Security

Security guards are routinely hired to provide security at public premises such as businesses, public parking garages, store parking lots, college campuses, malls and apartment complexes. If the negligence of security contractors causes injury to invited guests, the contractors or property owners may be responsible.

Public Sidewalks and Roadways

Owners of public sidewalks and roadways have a legal obligation to maintain these areas in a reasonable safe condition. The owners have a duty to routinely and responsibly maintain these areas in order to prevent danger to public users of the premises.
