Defective Vehicles and Car Accidents

The legal issues are complicated as far as determining liability when an injury is caused by a defective automobile or automobile part. Those liable for damages can include the vehicle manufacturer, the car dealership, the manufacturer of the automobile parts, such as tires and seat belts, or the distributor of the car parts.

Rollovers and roof collapses are the most common accidents caused by automobile defects as well as accidents from failed tires and injuries caused by faulty seat belts. Fires caused by faulty wiring and fuel systems defects have also been known to occur.

It is in your best interests to have an experienced defective vehicle attorney on your side if you have suffered an injury due to a defective vehicle or vehicle part. The vehicle is considered evidence and an experienced attorney will recognize that and take the necessary steps to preserve that evidence for you. Without the evidence of the defective vehicle you will have no case.

If you or someone you care about has suffered an injury in a car accident due to a defective vehicle or vehicle part being involved and you live in Orlando, Florida or the surrounding area, please contact The Law Offices of Michael Barszcz, M.D., J.D. today to schedule a confidential consultation at no cost to you to protect your legal rights and determine whether you are entitled to compensation for your injuries.

Personal Injury

When you sustain an injury due to the negligence of another person, then you have a personal injury claim. The most common types of personal injuries are sustained from:

• Auto, motorcycle, or truck accidents
• Accidents while on the job
• Slip and fall accidents
• Premise negligence or liability
• Defective products

All of these types of accidents can lead to an innocent person being hurt or even killed due to another party’s misconduct. That party is legally responsible for the injury to the innocent person. Some injuries are permanent, which can lead to loss of work and quality of life. The negligent party should be held responsible for those damages.

In order to successfully pursue a personal injury claim, it is important to seek the counsel of an experienced lawyer. Whiplash Injury Following a Car Accident

Whiplash injuries are defined as injuries to the neck that occur when a vehicle is hit from behind and the occupants of that vehicle that has been impacted are suddenly jerked forward and backward from the force of the impact.

This jerking action pushes the head and neck beyond their normal positions and causes trauma to the tissues of the neck, damage to the joints, discs, ligaments muscles and nerves. Whiplash is the most common car accident related injury and can occur at speeds as slow as ten miles an hour at impact.

Symptoms of whiplash include headache, neck pain, stiffness and dizziness. These symptoms can last for months or years if left untreated. It is very important to recognize the seriousness of this injury and obtain medical help as soon as possible. Treatment encompasses over the counter pain medication to professional medical treatment including neck massage, ice therapy and rehabilitation exercises.

If you or someone you care about was in a car accident and suffered a whiplash injury, and you live in Orlando, Florida or the surrounding area, please contact an experienced whiplash injury attorney at The Law Offices of Michael Barszcz, M.D., J.D. today to schedule a confidential consultation at no cost to you to find out how to protect your legal rights and determine whether you are entitled to compensation for your injuries.

Seat Belt Use and Car Accidents

Using a properly adjusted seat belt when driving or a passenger in an automobile dramatically increases a person’s chances of surviving a motor vehicle accident.

Occupants of a car can become projectiles in a collision, seriously injuring themselves and others in the car. Although air bags are an excellent addition to an automobile’s safety features, they do not prevent you from being ejected from the car in a collision.

Statistics reveal there were over 6.2 million car accidents last year, with 2.2 million of those accidents resulting in injuries. Over 40,000 people lost their lives in those accidents. Many of the injuries and deaths could have been avoided had seat belts been in use in some cases. The National Highway Traffic Safety Administration (NHTSA) states someone is killed every hour in this country because of failing to buckle up.

Over 60% of Americans who lost their lives in car accidents were not wearing their seat belts. Help yourself and those you care about stay safe and protected from the devastating effects of a car accident by making sure everyone is buckled-up every time you drive.

If you or someone you love was injured or killed in a car accident and you reside in Orlando, Florida or the surrounding area, please contact an experienced car accident attorney at The Law Offices of Michael Barszcz, M.D., J.D. today to schedule a confidential consultation at no cost to you to find out how to protect your legal rights and whether you are entitled to compensation for your injuries.
