Rear-End Car Accidents

Rear-end collisions are the most common type of automobile accident. While the majority of these accidents are easily avoidable, that doesn't change the fact that rear-end collisions can result in serious injury or even death. Orlando, Florida’s Law Offices of Michael Barszcz, M.D., J.D., help victims of rear-end car accidents every day.

The law assumes that the rear-ending driver in a rear-end collision is at fault, unless proven otherwise. This does not take into account the numerous reasons why a rear-end collision may occur. Modern distractions, such as cell phones, have only increased the level of driver distraction on the road. Even if the following motorist is driving attentively, rear-end collisions can still occur due to irregular driving on the part of the leading motorist.

In a rear-end collision, the first and most important line of defense is the bumper and rear crumple zones. The quality of the bumper mechanism can mean the difference between a rear-end collision with no injuries and a rear-end collision with injuries such as whiplash, spinal and brain injuries, fractures and concussions. A faulty bumper mechanism can exaggerate the effects of a rear-end collision and bumpers should always be examined after a collision to understand their role in any subsequent injuries. Even minor, slow-speed accidents can result in severe injury to passengers and major damage to property, but it is common for insurance companies to downplay the severity of this type of accident in order to deny or diminish your claim.

Determining fault and how compensation should be dealt out can be a difficult task. Thus, hiring a quality and experienced attorney to represent your interests is very important, especially considering the insurance companies' desires to minimize their own financial exposure. Insurance companies profit by paying out a minimum of claims.
